Practices

Bankruptcy

Primmer Piper Eggleston & Cramer represents both debtors and creditors in bankruptcy courts in Vermont and upstate New York, including in Chapter 7, 11, 12 and 13 cases.

  • Creditors' Rights. The firm has extensive experience in structuring complicated workouts and handling complex Chapter 11 cases on behalf of creditors. In addition, the firm's real estate, environmental, banking, and taxation experience allows its attorneys to effectively represent creditors in large, complex bankruptcy proceedings.
  • Protection of Debtors. For borrowers, bankruptcy is often a useful tool for debt restructuring. As an active part of its debtor and creditors' rights practice, the firm represents corporate debtors reorganizing under Chapter 11, farm debtors reorganizing under Chapter 12, and individual debtors either seeking a discharge in Chapter 7, or a reorganization in Chapter 13.
  • Buying and Selling Financially Distressed Businesses. Clients of the firm are often presented with the opportunity to purchase a distressed business or are faced with the prospect of selling one. Through its extensive experience representing creditors and debtors in bankruptcy proceedings, the firm is able to represent both buyers and sellers of financially distressed businesses.
  • Financing of Financially Distressed Businesses. Lenders are often presented with the opportunity to finance businesses which are either operating as debtors in possession or intend to file for protection under the Bankruptcy Code. In these situations, the firm is able to draw upon its experience in both banking and bankruptcy proceedings to advise its clients on how to negotiate and structure such financial arrangements.
