PPEC Gains Approval for First SPEED Certified Electric Generation Project in Vermont

Primmer Piper Eggleston & Cramer PC’s (PPEC) Energy and Telecommunications Law group, led by Elijah D. Emerson, obtained the necessary approvals for the Vermont Public Power Supply Authority’s $21.6 Million peaking generation unit in Swanton, Vermont (Project).  On January 21, 2009, the Vermont Public Service Board (Board) issued a Certificate of Public Good pursuant to 30 V.S.A. § 248 to construct the 40 MW Project, which will be capable of running off blended biodiesel.  PPEC also obtained approval pursuant to 30 V.S.A. § 108(a) for the approximately $25 Million in tax–exempt bonds issued to construct the Project.  On August 27, 2009, the Project became the first Sustainably Priced Energy Enterprise Development (SPEED) project certified by the Board.  With its SPEED certification, the Project will provide renewable electricity to twelve Vermont utilities and help to meet their renewable requirements.
